nautae caupones stabularii
an abbreviated form of part of the praetor's edict of the Roman law, which has been accepted as the law of Scotland and provides for the strict liability of the common carrier of goods, the stable-keeper and the innkeeper. The position of the common carrier of goods has been altered by statute; the position of the innkeeper has been altered by the Hotel Proprietors Act 1956. Liability is still strict, but it can be severely limited by displaying a notice under the schedule to the Act. The stable-keeper's liability remains in full force.
