in terms of the Crime and Disorder Act 1998, a period of up to two years' imprisonment can be added to a sentence where the crime involves a racial element. It has been suggested that the factors to be considered include the nature of the racial hostility, whether the location was public or private, the location, e.g. a mosque or synagogue, but that a discount might be considered for genuine remorse coupled with a guilty plea and previous good conduct: R v . Saunders [2000] TLR 52. There is a particular and new offence of racially aggravated conduct, which amounts to harassment either intended or which would appear to a reasonable person to amount to harassment causing alarm and distress. Racial aggravation is shown by racial hostility at the time of the offence or immediately before or after.
