breach of statutory duty

breach of statutory duty
As well as actions based on negligence, an injured person or one who suffers loss as a result of statutory breach can also claim for injury and other damage flowing from that breach. Not all statutes may be the basis for such an action but it would be applicable in cases of statutes for the benefit of a specific class of person (e.g. employees) as opposed to the public in general. Some statutes or sections within a statute specifically exclude an action for breach of statutory duty; e.g. sections 2-7 of the Health and Safety at Work Act 1974.
