running with the land
A phrase used in real estate law to describe a right or duty that remains with a piece of real estate no matter who owns it. For example, the duty to allow a public path across beachfront property would most likely pass from one owner of the property to the next.

Description of any right or responsibility which passes with the transfer of land, often with reference to easements or covenants, for example, where one driveway serves as an entrance to two homes, but is owned by only one of the homeowners, the right to use the driveway may be considered to "run with the land" upon sale of the home to another party.
