excluded assignment
An assignment in breach of a covenant of a tenancy or by operation of law. The effect of an excluded assignment is that:
• A tenant who has made an excluded assignment is not released from the tenant covenants until the next assignment that is not an excluded assignment.
• A landlord or former landlord is not entitled to apply for a release until the next assignment that is not an excluded assignment (section 11, Landlord and Tenant (Covenants) Act 1995).
