gross misconduct
Gross misconduct should ideally be defined in the employment contract and, where committed should allow the employer to dismiss without notice or prior warnings (summary dismissal or instant dismissal). Such conduct will normally include theft, violence, falsification of records and other serious matters. The list should be stated as being non-exhaustive to allow the employer discretion.

gross misconduct
Misconduct so serious as to justify summary dismissal of an employee. What constitutes gross misconduct may vary according to the particular circumstances of the employer and the work the employee is carrying out. Acts of gross misconduct, such as theft, fraud, physical violence, serious negligence or serious breach of health and safety regulations, will result in a serious breach of contractual terms and examples of such conduct will usually be given in an organisation's disciplinary procedure. When contemplating dismissing an employee for gross misconduct an employer will usually be required to undertake a DDP.
