inside information
1) This term has a different meaning depending on the context in which it is used:
• For the purposes of the criminal insider dealing regime under the Criminal Justice Act 1993, information which:
• relates to particular securities or to a particular issuer of securities and not to securities or issuers of securities generally;
• is specific and precise;
• has not been made public; and
• if it were made public would be likely to have a significant effect on the price of any securities.·
• For the purposes of the Financial Services and Markets Act 2000 (including the Disclosure Rules and market abuse regime), information of a precise nature which:
• is not generally available;
• relates directly or indirectly to one or more issuers of qualifying investments or to the qualifying investments themselves;
• would, if generally available, be likely to have a significant effect on the price of the qualifying investments or on the price of related investments.
For commodity derivatives, inside information is what users of the markets where such derivatives are traded would expect to receive in accordance with accepted market practices on those markets
2) Dealing in securities or shares on the basis of information that is not yet publicly known and which would affect the price of the securities or shares if it were made public.
