Health Information Technology for Economic and Clinical Health (HITECH) Act

A federal law enacted as part of the American Recovery and Reinvestment Act of 2009 (Pub. L. 111–5 (Feb. 17, 2009)) that amends the Health Insurance Portability and Accountability Act (HIPAA) to address privacy and security concerns associated with the electronic transmission of Protected Health Information (PHI). Among other things, the HITECH Act:
• Requires covered entities and their business associates to notify individuals about unauthorized disclosures of unsecured PHI.
• Allows individuals to request an audit trail of all disclosures of their electronic PHI.
• Prohibits the sale of PHI without authorization.
• Increases the penalties for HIPAA privacy and security violations.
