A business that, for profit or other commercial consideration, conducts, promotes, underwrites, arranges or sponsors a sale of goods or services, or a performance or event of any kind that is both:
• Advertised in conjunction with the name of any charitable or religious organization.
• Beneficial to, to any extent, that charitable or religious organization.
Some states regulate commercial co-venturers that participate in cause marketing campaigns. In these states, businesses that only benefit in goodwill typically are not considered a commercial co-venturer if the collection and distribution of the proceeds of the sale, performance or event are supervised and controlled by the benefiting charitable or religious organization.
