if at any time during the statutory prescriptive period the servient land was owned by an infant or a mentally incapacitated person (or, indeed, anyone other than anyone sui juris and holding the fee simple (fee simple absolute in possession) that period is excluded in relation to the acquisition of an easement or profit by prescription under the Prescription Act 1832 that depends, inter alia, on the servient owner being able to enforce his rights should he have chosen to.
