1. formerly, a contract for the sale of land was required to be at least evidenced by some memorandum in writing, setting out the principal points of the contract. Since the Law of Property (Miscellaneous Provisions) Act 1989, this is now insufficient, the requirement being that all such contracts be in writing. However, the requirement of a written memorandum still applies to contracts of guarantee.
2. the creation of a trust of land or of an interest therein must at least be evidenced by some note or memorandum in writing.
