summary cause

summary cause
a form of small debt action in Scotland. It replaced the small debt action and predates the small claim with which it overlaps. It was intended to be useful for laymen but is more like a stripped-down ordinary action convenient for debt collection. The rules have been interpreted rather strictly even in relation to points of pleadings, and it might be asked whether there is any real need for this intermediate tier of procedure. As from some time in 2001 it is likely that it may be used only in cases under £5,000.
