Under the Patents Act 1977, there are UK rules which govern the ownership of inventions made by employees. If the invention was made during the employee's normal or specifically assigned duties, the invention belongs to the employer. All other inventions belong to the employee. It is not possible to enforce any provision previously agreed to by the employee to sign away rights in or to the patents - however the employee can subsequently assign the rights. Where the employer owns the rights, or where they have been transferred to him by the employee, (and the benefit recovered by the employee was inadequate) then the employer must pay the employee compensation if its resulting patent was of outstanding benefit to the business.
