To qualify for many of the protections under employment legislation, the qualifying employment period must be continuous (Schedule 13 Employment Protection (Consolidation) Act 1978. For unfair dismissal and redundancy, two years' continuous employment is required. The two year qualifying period does not apply in cases of sex and race discrimination. The tribunal will assume continuity unless the employer proves otherwise. The rules as to continuity are particularly complicated and if you are trying to demonstrate a break in continuity, legal advice is essential.
