trade name n: a name or mark that is used by a person (as an individual proprietor or a corporation) to identify that person's business or vocation and that may also be used as a trademark or service mark
◇ Like a trademark or service mark, a trade name is protected by law against infringement. A trade name that has been used for at least 6 months can be recorded with the Customs Bureau, and any infringing imports will be barred.

The formal or official name of a business — that is, the name the business uses on its letterhead and bank account. A trade name may serve as a company's trademark if it is used to market the company's goods or services. For example, "Dell" is the trade name for Dell, Inc. It is also a trademark used by the company for personal computers, servers, software, and certain computer-related services. Compare: trademark

trade name, Also known as a commercial name.
The name that a business or company uses to identify itself in commerce. A business may use its legal name or a fictitious business name (also known as a DBA (short for doing business as) or an assumed name) as its trade name.
Trade names are not eligible for federal trademark registration under the Lanham Trademark Act unless that trade name also functions as a trademark or service mark.

trade name
n.
   a name of a business or one of its products which, by use of the name and public reputation, identifies the product as that of the business. A trade name belongs to the first business to use it, and the identification and reputation give it value and the right to protect the trade name against its use by others. Example: Sheaffer's is clearly identified as a fountain pen manufactured by the Sheaffer Company, and no one else can produce pens with that name. However, a motorcycle with the name Sheaffer would not be an infringement since the product is different.
