personal covenant
A covenant that is not intended to bind (or is incapable of binding) a successor in title of the covenantor.
In the context of the Landlord and Tenant (Covenants) Act 1995, a covenant by the landlord or the tenant that is expressed to be personal is not enforceable by or against any other person. A landlord is not released from a personal covenant by virtue of section 8 of the Act (BHP Petroleum v Chesterfield Properties [2002] L&TR 302) and, by analogy, a tenant would not be released from a personal covenant on assignment of the lease by virtue of section 5 of the Act.
