protected industrial action
industrial action will be protected if the trade union or unions that called the action have complied with the balloting and notification requirements of TULRCA. The union will be immune from liability in tort, and any employees taking part cannot be fairly dismissed for the first twelve weeks, after which they can be fairly dismissed only in certain circumstances.
