rectification
in English law, the power in the courts to correct a document that has been drawn in such a way that it incorrectly reflects the intention of the parties: Craddock v . Hunt [1923] 2 Ch. 136. Scots law had to await the Law Reform (Miscellaneous Provisions) (Scotland) Act 1985 for a similar measure.

rectification
The discretionary remedy of correcting of mistakes made in recording agreements. By its very nature, rectification is only applicable in the case of written contracts. A written contract is normally construed as it stands. The burden of proof is on the party seeking rectification who must be able to produce convincing proof that the agreement does not reflect the intentions of the parties and the agreement as rectified will reflect those intentions.
