Under the Fair Labor Standards Act (FLSA), employees who are exempt from coverage for minimum wage payment requirements and/or overtime requirements because they qualify for one or more exemptions carved out by the FLSA.
The primary and most highly litigated exemptions, which exempt employees from both requirements, are:
• Executive.
• Administrative.
• Professional.
• Outside sales.
• Computer professional.
Employers can claim these exemptions only if the employees in question meet specific job duties tests and are paid on a salary basis equal to at least $455 per week.
