Americans with Disabilities Act of 1990
Americans with Disabilities Act of 1990 (ADA), see also Title I and Title V of the Americans with Disabilities Act of 1990

A federal law prohibiting employment discrimination against qualified individuals on the basis of disability (42 U.S.C. §§ 12101-12113). The ADA specifically prohibits discrimination in the terms and conditions of employment, including:
• Application procedures.
• Hiring.
• Termination of employment.
• Compensation.
• Job training.
• Retaliation (for more information on retaliation, see Practice Note: Retaliation (www.practicallaw.com/5-501-1430)).
• Harassment (for more information on harassment, see Standard Document, Anti-Harassment Policy: General Drafting Note (www.practicallaw.com/7-501-6926) and Practice Note, Harassment (www.practicallaw.com/9-502-7844)).
The ADA is also the primary federal law governing:
• Reasonable accommodations of disabilities in the workplace.
• Pre-employment examinations.
The ADA is enforced by the Equal Employment Opportunity Commission (EEOC). The general rule is that the ADA applies to private employers with 15 or more employees.
